1. Introduction

Welcome to The Healthier You Coaching ("we," "our," "us"). By purchasing any of our online fitness coaching packages, you agree to these Terms & Conditions. We offer a variety of coaching packages to suit different needs, as detailed below.

2. Acceptance of Terms

By purchasing a package on our website, you accept and agree to abide by these Terms & Conditions. Additionally, you will be required to fill in and sign a form within the Everfit training app as part of the subscription process, reiterating your acceptance.

3. Services Provided

We offer six different packages:

• STARTER: Unlimited support, gym and home programs, knowledge libraries, and inside community access.
• PRO: Includes everything in Starter plus stretches workouts, mobility workouts, and form and technique feedback.
• ELITE: Includes everything in Pro plus nutrition coaching, weekly check-ins, and a recipe library.
• 1:1 COACHING: Includes everything in Elite plus a tailored training plan, monthly calls, and a welcome bag.
• STARTER RUNNING PACKAGE: Unlimited support from Elise and Jasper, personalized running plan with Jasper, conditioning programs, mobility and stretches workouts, knowledge library, community access, form and technique feedback, and monthly check-ins with Jasper.
• PRO RUNNING PACKAGE: Unlimited support from Elise and Jasper, personalized running plan with Jasper, conditioning programs, mobility and stretches workouts, knowledge library, nutrition coaching, recipe library, community access, form and technique feedback, weekly check-ins with Elise, and monthly check-ins with Jasper.

Our workout library is regularly updated. Unlimited support varies by package and is provided via the in-app messenger, with response times guaranteed within 5 business days (Starter), 3 business days (Pro), 2 business days (Elite), and 1 business day (1:1 Coaching).

4. Payment Terms

Purchases are processed through the Everfit portal, secured by Stripe. Subscriptions renew automatically on a monthly or yearly basis, depending on the option chosen. You can cancel your subscription anytime before the renewal date by logging into https://client.everfit.io/. A free trial is available for the first three packages (Starter, Pro, Elite), with charges beginning after seven days. No refunds are available beyond this trial period. In the event of a failed payment, clients will receive reminders to process the payment as follows: - Immediately after payment fails - 3 days after payment failure - 5 days after payment failure If payment is not successfully processed after the final reminder, the coach reserves the right to cancel the client's plan effective immediately.  

5. Refund Policy

All sales are final. No refunds will be given under any circumstances except in cases where the purchased package was not offered. Proof must be provided for any refund request.  

6. Cancellation by The Healthier You

The Healthier You reserves the right to cancel any subscription without prior notice for any reason, including but not limited to a violation of these Terms or if payment is not received.

7. User Obligations

Users must provide accurate information and ensure they have their doctor's approval to undertake physical activities. We are not responsible for any consequences resulting from the application of our advice or workouts.

8. Intellectual Property

Users cannot sell our programs or disclose any proprietary in-app information to the public.

9. Limitation of Liability

Our liability is limited to providing guidance and advice according to industry standards for fitness coaches. We are not liable for personal injuries or accidents resulting from the use of our programs.

10. Governing Law

These Terms & Conditions are governed by the laws of Spain

11. Amendments to Terms

We reserve the right to update these Terms & Conditions. Changes will be communicated through our website.
